COURT DISMISSES MULTICHOICE’S OBJECTION TO MCSN’S N5.2 BILLION COPYRIGHT SUIT


A Federal High Court sitting in Lagos on Monday dismissed preliminary objections filed by Multichoice Nigeria Ltd against the N5.2 billion suit brought against it by the Musical Copyright Society of Nigeria for alleged illegal use of copyright work from 2006 till date.

While ruling on the matter, Justice Mohammed Idris stated that the Compact Disc judgment cited by Multichoice is not applicable to the suit and subsequently fixed November 1, 2012 for trial.Multichoice had earlier on filed a writ of summons against MCSN, praying the court to grant a perpetual injunction stopping MCSN from asking Multichoice to obtain copyright licence for the broadcast of musical works on its radio and television channels since MCSN was neither licensed nor approved by the Nigerian Copyright Commission as a collecting society.
